Tenant's Rights
A tenant is the lifeline of any rental business and not respecting his rights can lead to losses and bad business. Hence, it is of utmost importance that landlords respect a tenant. Even from a legal point of view, most states have tenant's rights clearly mentioned in their rule books and there are tenant associations as well who fight for these rights. Since the tenant pays a rent and creates income for the landlord, it is vital that his rights are protected.
The most important right of a tenant is his right against discrimination. He has every right to fight against any bias that he feels has been done to reject his tenancy application. He cannot be rejected based on caste, religion, color, sex or even marital status. The selection has to be based on pure merit and he can appeal against any such rejection, if he feels that the procedure has been biased. The tenant also has a right to stay in a home of good condition, if he is paying a rent for it. He can ask the landlord to repair any systems that are found to be defective. These systems should be certified and the tenant can demand an inspection of these systems by an authorized home inspector, so that he can be sure that the house is safe to live in.
The security of the house is also a right that can be demanded by the tenant. He can demand that the landlord provide good locking systems that ensure a secure living. A good hospitable and livable home, free of any pests or structural issues is another important aspect that the tenant can demand from the landlord. The right to have access to an agreement is another important right that the tenant can exercise. The landlord has to make the agreement which should contain all relevant clauses related to the tenancy. The tenant also has the right to get back the security deposit with interest earned on that amount, at the end of the tenancy, when he vacates and moves from the premises.
The tenant should have unlimited access to all areas of the house for which he is paying a rent. He also has the right to demand that the landlord does not use any of the rental premises for any activity, after the same has been included in the tenancy. In some states, tenants can claim for services like garbage clearance and drinking water to be arranged by the landlord. These are stipulated by the government because of certain conditions that exist in these states. There are also laws which help tenants to wriggle out of contentious agreements that have been made by some scrupulous owners to take advantage of innocent renters.
